These terms govern your use of the mobile application High Pressure Planner („the app“). Installing or using the app means you accept them. If you do not accept them, do not use the app.

2. What the app is — and what it is not

High Pressure Planner is a decompression planning aid for trained, certified divers. It computes schedules using well-established decompression models (Bühlmann ZH-L16 with gradient factors).

Diving is dangerous, and decompression diving especially so. No app can make it safe. The app does not replace training, certification, dive tables, a dive computer, a briefing, or your own judgement. You are responsible for verifying every plan against your own training and equipment before you dive it, and for the decisions you make in the water.

Use the app only for diving you are properly trained and certified for.

3. Licence

You get a personal, non-exclusive, non-transferable licence to use the app on devices you control, for your own diving. You may not sell, rent, sublicense or redistribute it, and you may not reverse engineer, decompile or modify it except where the law expressly permits it despite this clause.

The app, its name and its artwork remain ours. Dive plans you create are yours.

4. Subscriptions

Some features require a paid subscription. Tiers follow certification levels — Advanced Nitrox, Normoxic Trimix and Full Trimix — and recreational planning is free.

  • Subscriptions are sold and billed by the app store you installed from (Google Play or the Apple App Store), never by us directly. Prices are shown in the app before you buy.
  • Subscriptions renew automatically for the same period unless cancelled at least 24 hours before the current period ends. A free trial converts into a paid period the same way.
  • Manage or cancel a subscription in your store account settings (Google Play → Subscriptions, or Apple Account → Subscriptions). Cancelling stops the next renewal; it does not shorten the period you already paid for.
  • Refunds are handled by the store under its own policy. Consumer rights under Austrian and EU law are unaffected by anything in these terms.
5. Availability and changes

The app is provided as it is at the time you use it. Features may change between versions, and a subscription tier’s contents may change; if a change materially reduces what a paid tier offers, you may cancel as described above. Server-side subscription verification may be unavailable temporarily — the app is built to keep working offline from its last known state.

6. Privacy

Your dive plans and settings stay on your device. What little leaves it — the proof of purchase used to verify a subscription, and on Android the opt-in crash and analytics reporting — is described in the Privacy Policy, which forms part of these terms.

7. Liability

To the fullest extent permitted by law, we are not liable for injury, loss or damage arising from the use of the app, including any dive planned with it. Nothing in these terms limits liability that cannot be limited by law — in particular liability for death or personal injury caused by negligence, for gross negligence or intent, or under mandatory consumer protection law.

There is no warranty of any kind, express or implied: the app is provided „as is“, and we do not warrant that its calculations are correct, complete, or suitable for your dive.

8. Ending the agreement

You may stop using the app at any time by uninstalling it; cancel any subscription in your store account first. We may suspend or end your licence if you breach these terms in a way that matters — for example by redistributing the app.

9. Governing law

Austrian law applies, excluding its conflict-of-law rules and without depriving you of the protection of mandatory provisions of the law of your country of residence. If you are a consumer, you may bring proceedings in the courts of your place of residence.

10. If you installed from the Apple App Store

These additional terms apply when you obtained the app through Apple’s App Store:

  • These terms are an agreement between you and us only — not with Apple. Apple is not responsible for the app or its content, and has no obligation to provide any maintenance or support for it.
  • If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) to you. To the fullest extent permitted by law, Apple has no other warranty obligation for the app; everything else warranty-related is governed by section 7.
  • We, not Apple, are responsible for addressing any claim relating to the app or your use of it, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar law.
  • If a third party claims the app infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated a „terrorist supporting“ country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
11. Changes to these terms

We may update these terms; the current version is always the one on this page, with its date at the top. Continued use after a change means you accept it. Material changes will be pointed out in the app where reasonably possible.

High Pressure Group Susanne & Lukas Rössler GesbR

E-Mail: info@highpressuregroup.net
